Welcome to ShortRent.in. By accessing or using our website, mobile application, or services, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our services.

1. Nature of Service (Intermediary Status)

ShortRent.in operates strictly as an "Intermediary" as defined under Section 2(1)(w) of the Information Technology Act, 2000. Our platform serves as a digital marketplace to connect:

• "Users" (individuals or businesses seeking to rent equipment) and
• "Providers" (independent third-party owners or suppliers of equipment).

ShortRent.in does not own, operate, maintain, or control the construction equipment listed on the platform. We are not a party to any rental agreement, transaction, or contract entered into between the User and the Provider.

2. Limitation of Liability

To the fullest extent permitted by Indian law, ShortRent.in, its directors, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of:

• Equipment Failure: Any breakdown, malfunction, or safety issue related to the equipment provided by the Provider.
• Service Disputes: Delays, cancellations, or non-performance by the Provider or the User.
• Personal Injury or Damage: Any physical injury, accident, death, or property damage occurring during the transportation or operation of the rented equipment.
• Financial Disputes: Disagreements regarding rental rates, security deposits, overtime charges, or fuel costs.

The User acknowledges that the risk of using the equipment rests entirely with the User and the Provider.

3. Role of Users and Providers

• For Users: You agree to provide accurate details regarding your requirement. You are responsible for verifying the condition of the equipment upon delivery. You must ensure that the equipment is operated by qualified personnel only.
• For Providers: You warrant that the equipment listed is in good working condition, compliant with safety norms, and legally owned by you. You are solely responsible for the maintenance and logistics of the equipment.

4. No Guarantee of Service

While ShortRent.in strives to verify Providers (indicated by badges such as "Verified"), we do not guarantee the accuracy, completeness, or reliability of any listing. Availability of equipment is subject to confirmation by the Provider. We do not endorse or warranty the quality or safety of any specific machine.

5. Indemnification

You agree to indemnify, defend, and hold harmless ShortRent.in and its affiliates from and against any and all claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or in any way connected with:

• Your access to or use of the Platform.
• Your violation of these Terms.
• Any dispute between you and a Provider or you and a User.
• Your violation of any third-party right, including without limitation any intellectual property, publicity, confidentiality, property, or privacy right.

6. Dispute Resolution

Any dispute, controversy, or claim arising out of the rental transaction (including quality of service, payment, or damages) must be resolved directly between the User and the Provider. ShortRent.in acts solely as a facilitator and is not obligated to mediate or resolve such disputes.

7. Payments and Refunds

ShortRent.in may facilitate payments between parties or may allow direct payments. In cases where ShortRent.in collects payment, we act merely as a limited payment collection agent. Any request for refunds due to service issues must be directed to the Provider according to their specific cancellation policy.

8. Intellectual Property

All content on this website, including text, graphics, logos, and software code, is the property of ShortRent.in and is protected by Indian and international copyright laws.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any legal suit, action, or proceeding arising out of or related to these Terms or the Platform shall be instituted exclusively in the courts of Ahmedabad, Gujarat.
